1. Acceptance
These Terms of Service (“Terms”) are an agreement between you and Mirthilo Studio (“Mirthilo,” “we,” “us,” or “our”) governing your access to the DARTS: Real Throw web game at darts.mirthilo.com and related web services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old, or the minimum age required in your country to consent to online services. If you are not old enough to enter a binding agreement, a parent or legal guardian must review and accept these Terms for you. You may not use the Service where prohibited by law.
3. Accounts and Google sign-in
You may be able to play as a guest or create an account using a login name and password or Google sign-in. New password accounts use a login name, not an email address. You are responsible for accurate information, safeguarding your credentials, and activity under your account. Do not share, sell, or transfer your account. Tell us promptly at [email protected] if you suspect unauthorized use.
Google sign-in is optional and is also governed by Google’s applicable terms. You authorize us to use the basic Google account information described in our Privacy Policy to authenticate and operate your game account.
4. Cookies and browser storage
The web game uses an account-session cookie and local browser storage to provide requested functionality, including keeping signed-in users authenticated and remembering local game settings, calibration, scores, and preferences. We do not use our own advertising, analytics, or cross-site tracking cookies in the web game. Optional Google sign-in, Cloudflare human verification, and Stripe checkout are subject to the relevant provider’s own terms and privacy practices.

5. Playing safely
DARTS: Real Throw uses camera-based hand tracking and physical gestures. Make sure you have enough clear space, secure your device, and stay aware of people, pets, screens, furniture, and other objects around you. Use controlled gestures. Do not throw real darts or other physical objects at a device or person. Stop playing if you feel discomfort, dizziness, or strain.
6. Fair play and acceptable use
You agree not to:
- Cheat, automate play, falsify scores, manipulate telemetry, or interfere with result verification.
- Access another user’s account or probe, disrupt, overload, or bypass the Service’s security.
- Reverse engineer or copy the Service except where applicable law expressly permits it.
- Use the Service to harass others, impersonate a person or organization, or publish unlawful or harmful content.
- Use bots, scrapers, or automated systems without our written permission.
- Use the Service commercially or resell access unless we agree in writing.
We may reject scores, remove leaderboard entries, restrict features, or suspend accounts where we reasonably believe these rules were violated.
7. Profiles and leaderboards
If you enable leaderboard publication, you allow us to display and use your display name and game results to operate and promote Service leaderboards. You must have the right to use any name or image you provide. Do not use misleading, infringing, hateful, obscene, or personally sensitive profile content. We may moderate or remove profile content and results.
8. Purchases and digital items
The Service may offer paid cosmetic features, access entitlements, or other digital items. Prices, taxes, currencies, and included content are shown before purchase. Payments are processed by Stripe, whose payment terms also apply.
Digital items are licensed, not sold, and provide a personal, limited, non-transferable right to use them with the Service. Except where required by law or the payment provider’s rules, purchases are final after delivery. We may change or discontinue digital items, but we will not intentionally remove a paid entitlement without a valid reason such as refund, fraud, chargeback, legal requirement, or violation of these Terms.
9. Ownership
The Service—including its software, artwork, designs, audio, text, characters, trademarks, and game content—is owned by Mirthilo or its licensors and protected by intellectual-property laws. We grant you a personal, revocable, non-exclusive, non-transferable license to use the Service for non-commercial entertainment in accordance with these Terms.
10. Third-party services
The Service may rely on or link to third-party services such as Google, Cloudflare, Stripe, and community platforms. We do not control those services and are not responsible for their content, availability, or separate practices. Your use of them may be subject to their own terms and policies.
11. Availability and changes
We may update, rebalance, suspend, or discontinue parts of the Service and may perform maintenance without notice. We do not promise that the Service will always be available, uninterrupted, secure, or compatible with every device, browser, camera, or network.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms limits rights or warranties that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, Mirthilo and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the claim or US$50. These limits do not apply where prohibited by law.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.
15. Governing terms
These Terms are governed by the laws applicable where Mirthilo Studio is established, without regard to conflict-of-law principles, except that mandatory consumer laws in your place of residence continue to apply. Before starting formal proceedings, you and Mirthilo agree to try in good faith to resolve a dispute by contacting the other party.
If any provision is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, or transfer of the Service.
16. Changes and contact
We may update these Terms from time to time. We will post the revised version here and change the effective date. Your continued use after updated Terms take effect means you accept them, to the extent permitted by law.
